A Temporary Event Notice (TEN), authorises any event involving any form of licensable activity in a premises that is not already licensed for that activity or additional licensable activities in premises that are already licensed. It can also be used to extend the hours of a licensable activities in premises that are already licensed.

Licensable activity includes:

• selling alcohol
• serving alcohol to members of a private club
• providing entertainment, such as music, dancing or indoor sporting events
• serving hot food or drink between 11pm and 5am

‘Serving’ a Temporary Event Notice is how the process of applying for a TEN is formally known.

 

How many people can attend an event under a Temporary Events Notice?

The event must have fewer than 500 people at all times – including staff running the event.

How long can an event last under a Temporary Events Notice?

The event must last no more than 168 hours (7 days).

At what age can I apply for a Temporary Events Notice?

 

You must be at least 18 to apply for a TEN.

 

Can a company apply for a Temporary Events Notice?

 NO. You can only apply for a TEN as an individual, not an organisation.

Is there a restriction on the number of notices you can apply for?

 

You can get up to 5 TENs a year. If you already have a personal licence to sell alcohol, you can be given up to 50 TENs a year.

Is there a restriction on the number of Temporary Events Notice a premises can have?

A single premises can have up to 15 TENs applied for in one year, as long as the total length of the events is not more than 21 days. You need a TEN for each event you hold on the same premises. If you’re organising separate but consecutive events, there must be at least a 24 hour gap between them.

How do you apply for a Temporary Event Notice?

You can apply for a TEN by contacting your local council or here at Innpacked we can take care of the full process on your behalf.

How close to the event can I apply for a Temporary Event Notice?

You must apply at least 10 clear working days before your event.

What if I miss the 10 clear working days deadline?

 

You can apply for a ‘late TEN’. The latest you can apply for a ‘late TEN’ is 5 clear working days before the event (but not earlier than 9 clear working days).

Is there a limit to the number of Late TENs I can serve?

If you don’t hold a personal licence, you can serve up to 2 late TENs per year. If you hold a personal licence, the limit is 10. Late TENs count towards the total number of permitted TENs.

Who can object to a TEN?

 

The police or Environmental Health can object to a TEN. They must do this within 3 working days of receiving it. They can only object if they think the event lead to or cause:
• crime and disorder
• a public nuisance
• a threat to public safety
• children being put at risk of harm

Can I defend the TEN if there are objections?

 

If there’s an objection, your council’s licensing committee will hold a meeting unless all parties agree that a hearing isn’t needed. At the hearing, the committee have the power to approve, add conditions or reject the notice. If a late TEN is objected to by police or Environmental Health, the notice won’t be valid and you can’t hold the event.

Can I appeal if the TEN is refused?

You can appeal to your local magistrates’ court if you disagree with the licensing committee decision within 21 days, and at least 5 working days before the date of your event.

Do I have to display the notice at the event?

You must also display a copy of the notice where it can be easily seen and keep the original in a safe place where the event is held.

Are there any fines or penalties related to TEMPORARY Event Notices?

 

You could face prosecution if you breach the terms or conditions attached to the notice. You could also be fined if you make any false statements in your application.

If you carry out an activity that you should have a licence for (or allow your premises to be used for one) without a TEN and, you can be sent to prison for up to 6 months or fined or both.

      A Personal Licence is the licence held by an individual who wishes to sell or authorise the sale of alcohol on a licensed premises. Though not all staff at your venue need to have a Personal Licence, they must be authorised by the DPS (Designated Premises Supervisor), an employee who does hold a Personal Licence.

      An application for a Personal Licence must be accompanied by a Criminal Records Bureau Basic Declaration, and an APLH Level 2 qualification is also necessary before you can apply.

      How do I ensure that I don’t breach any of my premises licence conditions?

      As you are no doubt aware, not complying with your obligations as a designated premises supervisor or a premises licence holder, can be expensive if not fatal to your business. Many offences carry an unlimited fine and some carry six months in prison. That’s not even taking into account the possibility of the premises licence being reviewed, suspended or the worst-case scenario revoked.

      The best “defence” against these punishments is obviously, to avoid breaking the law in the first place. Most licence holders fall foul of the Licensing Act 2003 due to either failure to review processes or ignorance of the law and not a cynical attempt to subvert the rules.

      Lack of knowledge is not a defence under the act, because as a licence holder it is expected that you have taken your role seriously enough to make yourself aware of the licence holder’s responsibilities under the Act.

      It is possible to take out a “loss of licence insurance policy” which you would assume would take care of any loss of your premises licence. Most of these “loss of licence insurance policies” will cover you if there is a “sudden and unforeseen” loss of licence. As a general rule these insurance policies will not cover you if the loss of licence is due to either the actions of the licence holder whether knowingly or accidently or by neglect or omission or the police objecting to your licence, as these are not viewed as unforeseen. So as you can see this may not be the most suitable option if you wish to protect your licence.

      Change of Designated Premises Supervisor

      When YOU NEED to change a DPS?

      Alcohol can NOT be legally sold if there is no Designated Premises Supervisor in place.

      You must change a DPS when the current Designated Premises Supervisor no longer works at the premises or has had their personal licence suspended.

      Innpacked’s licensing team can process the whole application for you.

      All you need to do is submit a signed consent form by the current designated premises supervisor, which we will provide you with and a scan of your old licence (or explanation of why you can’t send it).

      2 Temporary Events Notices

      If you have a Premises Licence, but the Licensed Activity you wish to hold is not covered by your existing licence, such as a wedding reception, a Temporary Events Notice is also necessary.

      The terms of a Temporary Events Notice include:

      1. The event must comprise fewer than 500 people at all times, which includes all staff.
      2. The event must last no longer than 7 days.
      3. You must be at least 18 years of age to apply.
      4. You need a separate TEN for each event held at the premises.
      5. If you hold a Personal Licence, you can apply for up to 50 per year.
      6. If holding consecutive, separate events, there must be at least a 24 hour gap between each one.
      7. A single premises can apply for 12 TENs a year.
      8. A copy of the TEN should be sent to the police at least 10 working days before the event takes place. However, if you make your application online, the council will usually contact the police on your behalf.
      9. You can only apply for a TEN as an individual.

      Administration of your training records

      Due diligence is an important aspect of running a premises with an alcohol licence. Due diligence means that you take all reasonable measures to avoid any breach of your licensing conditions. Training and training records are an integral part of proving that you as the premises licence holder have taken all reasonable steps to ensure that your premises is operating within the terms of your licence.

      It is important that you are aware of which new staff require training when they join your business and which of the current staff have been trained to a sufficient standard, and any updates to their training are delivered at the relevant time. Not only should these measures be taken but it is vitally important that you can prove they have been taken. This is why it is important to have a coherent training schedule and well-maintained training records.

      You should make a Premises Licence Application if you intend to sell alcohol or provide Licensable Activities from a particular venue.
      Licensable Activities include:

      The sale of alcohol
      Regulated entertainment
      Late night refreshment

      To make a premises licence application you will be required to:

      Complete and submit all of the relevant application forms to the local council
      Liaise and negotiate with your local council
      Produce a plan of the building
      Submit a copy of your application form to 9 responsible authorities
      Find out the relevant fee for your particular venue
      Produce an advert to display in the local press
      Produce a notice which will need to be displayed outside your premises
