A pavement licence (or a pavement café licence) permits business owners to arrange tables and chairs and other furniture on a public pavement or highway so their customers can eat and drink outside. When will a pavement licence not be granted?
Pavement licences are granted under Part 7A of the Highways Act 1980. Licences are only granted for the types of highways listed in section 115A(1) of the Act. These only tend to be highways where no vehicle access is allowed, or vehicle access is restricted.
Does a pavement licence permit alcohol sales?
No. A pavement licence is simply a licence to place furniture on the pavement or highway adjacent to your premises. To sell alcohol you will still need to apply for a premises licence and a personal licence.
What documents do you need to support your pavement licence application?
You need to provide the following information with your pavement licence application:
- Your contact details.
- The address and location of your business premises, including any relevant floor plans or site maps showing the area outside where you intend to place furniture.
- A description or plan showing how you will arrange tables, chairs, barriers, umbrellas and any other furniture. This may include details about the dimensions and number of furniture items. You might enclose photographs.
- Details of the specific purpose of the outdoor seating area (for example, alcohol consumption).
- The proposed days and hours when the outdoor seating area will be used.
- Details of your public liability insurance to prove your outdoor seating area is covered by insurance.
