How do I ensure that I don’t breach any of my premises licence conditions?

As you are no doubt aware, not complying with your obligations as a designated premises supervisor or a premises licence holder, can be expensive if not fatal to your business. Many offences carry an unlimited fine and some carry six months in prison. That’s not even taking into account the possibility of the premises licence being reviewed, suspended or the worst-case scenario revoked.

The best “defence” against these punishments is obviously, to avoid breaking the law in the first place. Most licence holders fall foul of the Licensing Act 2003 due to either failure to review processes or ignorance of the law and not a cynical attempt to subvert the rules.

Lack of knowledge is not a defence under the act, because as a licence holder it is expected that you have taken your role seriously enough to make yourself aware of the licence holder’s responsibilities under the Act.

It is possible to take out a “loss of licence insurance policy” which you would assume would take care of any loss of your premises licence. Most of these “loss of licence insurance policies” will cover you if there is a “sudden and unforeseen” loss of licence. As a general rule these insurance policies will not cover you if the loss of licence is due to either the actions of the licence holder whether knowingly or accidently or by neglect or omission or the police objecting to your licence, as these are not viewed as unforeseen. So as you can see this may not be the most suitable option if you wish to protect your licence.

Bespoke Staff Induction Handbook

Your Bespoke Staff Induction Handbook will be unique to your premises.

Included will be your premises policies with regards to violence, drugs, and prevention of underage sales amongst many other points that will be relevant to your operating schedule and the licensing objectives. If you do not have some of these policies in place Innpacked will review what you do have and create new ones with you.

The design of YOUR Staff Induction Handbook will be produced in conjunction with your current policies and the Innpacked licence teams observation and recommendations.

This book will ensure that any member of your staff will be aware of their responsibilities and duties when involved in the retail of alcohol on your premises and they will also sign to acknowledge that they have been aware of these.

Change of Designated Premises Supervisor

When YOU NEED to change a DPS?

Alcohol can NOT be legally sold if there is no Designated Premises Supervisor in place.

You must change a DPS when the current Designated Premises Supervisor no longer works at the premises or has had their personal licence suspended.

Innpacked’s licensing team can process the whole application for you.

All you need to do is submit a signed consent form by the current designated premises supervisor, which we will provide you with and a scan of your old licence (or explanation of why you can’t send it).

2 Temporary Events Notices

If you have a Premises Licence, but the Licensed Activity you wish to hold is not covered by your existing licence, such as a wedding reception, a Temporary Events Notice is also necessary.

The terms of a Temporary Events Notice include:

1. The event must comprise fewer than 500 people at all times, which includes all staff.
2. The event must last no longer than 7 days.
3. You must be at least 18 years of age to apply.
4. You need a separate TEN for each event held at the premises.
5. If you hold a Personal Licence, you can apply for up to 50 per year.
6. If holding consecutive, separate events, there must be at least a 24 hour gap between each one.
7. A single premises can apply for 12 TENs a year.
8. A copy of the TEN should be sent to the police at least 10 working days before the event takes place. However, if you make your application online, the council will usually contact the police on your behalf.
9. You can only apply for a TEN as an individual.

Administration of your training records

Due diligence is an important aspect of running a premises with an alcohol licence. Due diligence means that you take all reasonable measures to avoid any breach of your licensing conditions. Training and training records are an integral part of proving that you as the premises licence holder have taken all reasonable steps to ensure that your premises is operating within the terms of your licence.

It is important that you are aware of which new staff require training when they join your business and which of the current staff have been trained to a sufficient standard, and any updates to their training are delivered at the relevant time. Not only should these measures be taken but it is vitally important that you can prove they have been taken. This is why it is important to have a coherent training schedule and well-maintained training records.

A Personal Licence is the licence held by an individual who wishes to sell or authorise the sale of alcohol on a licensed premises. Though not all staff at your venue need to have a Personal Licence, they must be authorised by the DPS (Designated Premises Supervisor), an employee who does hold a Personal Licence.

An application for a Personal Licence must be accompanied by a Criminal Records Bureau Basic Declaration, and an APLH Level 2 qualification is also necessary before you can apply.

Innpacked can make the application on your behalf for both your Criminal Record Declaration and your Personal Licence.
